2022年11月、仮想通貨大手取引所FTXに関して、倒産の危機があるなどのニュースが流れている。記事作成時点（2022年11月10日）においてはFTXが倒産するかどうかが確定していないものの、日本人が多く利用している取引所であるFTX Japanからは出金停止の状態となっている。&nbsp;<img src="https://pafin-cortex-production.s3.ap-northeast-1.amazonaws.com/FTX_Japan_52426d8086.png" alt="FTX Japan.png" srcset="https://pafin-cortex-production.s3.ap-northeast-1.amazonaws.com/thumbnail_FTX_Japan_52426d8086.png 245w,https://pafin-cortex-production.s3.ap-northeast-1.amazonaws.com/small_FTX_Japan_52426d8086.png 500w,https://pafin-cortex-production.s3.ap-northeast-1.amazonaws.com/medium_FTX_Japan_52426d8086.png 750w,https://pafin-cortex-production.s3.ap-northeast-1.amazonaws.com/large_FTX_Japan_52426d8086.png 1000w," sizes="100vw">（参考：2022年11月11日 10時時点の<a href="https://ftx.com/jp">FTX Japan</a>のHP。出金が停止しているとの警告文が記載されている）※補足 2022年11月11日 11:00頃からFTX Japanの出金が始まった模様。また2022年11月10日に関東財務局より、FTX Japanに業務停止命令が出ている。（参考：関東財務局「<a href="https://lfb.mof.go.jp/kantou/kinyuu/pagekthp0270000011.html">FTX Japan株式会社に対する行政処分について」</a>）ここでは、仮想通貨の税務に精通している税理士により、取引所が倒産危機になり出金が停止した場合の税務上の取り扱いについて解説する。<h2>出金停止のみでは損失計上できない</h2>税務上、暗号資産取引所が倒産等してしまい、そこに預けてある暗号資産に毀損が生じた場合は、「貸倒損失」として雑所得の損失に計上することができる。ただ、今回のように出金が制限されており、取引所から銀行口座等への送金が止められている状態のみでは、貸倒損失として損失計上できないとみられている。なぜならば、貸倒損失については、税法上で明確に要件が定義されているためだ。一般的に「出金停止状態」という要件のみでは貸倒損失を計上することができないこととなる。税法に定める貸倒損失の要件を満たす必要があるため、その要件を満たした時に、貸倒損失として損失計上することができることとなる。<h2>&nbsp;税務上の損失計上できる要件</h2>それでは、実際に税法上の損失計上ができる要件について、こちらで解説する。税金の計算上において貸倒損失として損失計上するためには、大きく分けると法律上の要件と実質的な要件の２つが存在する。<figure class="table"><table style="border-color:hsl(0, 75%, 60%);border-style:dotted;"><tbody><tr><td>【法律上の要件】<ul><li>会社が倒産し、会社更生法、民事再生法等の規定に基づいて裁判所が下す許認可決定がある場合</li><li>法令の規定による整理手続きに寄らない債権者集会の協議決定及び行政機関や金融機関などのあっせんによる協議がある場合</li><li>債務者の債務超過の状態が相当期間継続し、その金銭債権の弁済を受けることができないと認められる場合</li></ul></td></tr></tbody></table></figure>&nbsp;<figure class="table"><table style="border-color:hsl(0, 75%, 60%);border-style:dotted;"><tbody><tr><td>【実質的な要件】<ul><li>継続取引を行っていた債務者の資産状況・支払い能力等が悪化したたため取引停止し、その後１年以上経過した場合</li><li>同一地域の債務者に対する売掛債権の総額が取引費用より少なく、支払いを督促しても弁済がない場合</li></ul></td></tr></tbody></table></figure>&nbsp;要は、法律的に倒産していることが確定する、もしくは長期間（１年以上）の取引停止であれば税務上の貸倒損失の要件を満たすことになるのである。上記の要件を満たした場合であれば、回収することができないと見られる部分について、貸倒損失として損失計上することができる。今回のFTX Japanの出金停止状態は、法律上の要件も実質的な要件も満たしていないこととなるため、「出金停止状態のみでは、損失計上することができない」となる。&nbsp;<h2>2023年度の確定申告について</h2>FTXの倒産のニュースは、2022年11月上旬に出てきたばかりのニュースであり、上述のような法律上の要件もしくは実質的な要件のどちらかを満たすのは、早くても2023年頃になるとみられている。そのため、2022年分の所得を申告する2023年度の確定申告においては、FTX Japanの取引所に預けてある暗号資産を損失として計上することはできないと見込まれている。万が一、2022年中に法律的に倒産するのであれば話は別であるが、現在の状態のまま大きく進捗しないのであれば、出金停止金額をもって損失計上は早いので留意したい。 なお、仮想通貨の損益通算ツール「クリプタクト」が運営している当ブログでは、仮想通貨関連の最新情報を含むさまざまな記事を定期的に公開しています。最新情報が知りたい方は、クリプタクトに登録すると受け取れる<a href="https://grid.cryptact.com/signup">メルマガを登録</a>したり<a href="https://twitter.com/Cryptact">公式Twitterアカウント</a>をフォローしたりしてみてください。 &nbsp;
